We respect your privacy and are committed to protecting it through our compliance with this Policy. This Policy describes the types of information we may collect about you or that you may provide to us when you visit the website viewstub.com, any of its subpages or any other website where we post this Policy (collectively, our “Website“) or when you use our online ViewStub platform connecting Fans and Event Organizers (whether on and through the Website or through our downloadable mobile application, the “Platform” and, together with the Website, our “Services“) and our practices for collecting, using, maintaining, protecting and disclosing that information.

 

Depending on the context, “you” may be either (1) an individual consumer using our Services for your own personal use to find, purchase tickets for and manage your experience at one or more in-person or virtual performances or other events (a “Fan“), or (2) an individual employee, contractor, agent or other personnel (“Event Personnel“) of an event venue or other event organizer that is an actual or prospective business subscriber to our Services (an “Event Organizer“).  

 

This Policy applies to any information that we collect on and in connection with your use of the Services, including any information in any forms or messages submitted by you to us through our Services or using the contact information provided on our Services. This Policy does not apply to any information that we collect by any other means.

 

Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, you can choose not to use our Services. By accessing or using our Services, you agree to this Policy. This Policy may change from time to time. Your continued use of the Services after we make changes is deemed to be acceptance of those changes.

 

Information We Collect About You and How We Collect It

 

Personal Information We Collect

 

We may collect several types of information from and about users of our Services. This may include information by which users may be personally identified or information about a user that is maintained in personally-identifiable form (collectively “Personal Information“). Specifically, we (or our third party service providers acting on our behalf) may collect the following:

 

From Fans:

 

  • Your name.
  • Your telephone number (including mobile telephone number).
  • Your email address.
  • A profile picture (should you choose to upload one in your account)
  • The IP address or Mobile Device ID of the computer or device used to log in to our Services.
  • Your city and state/province and/or zip/postal code.   
  • Transactional data, such as your transaction history on the Services.  
  • Records of tickets purchased or considered or other purchasing or consuming histories or tendencies.
  • Browsing history, search history or other information on your interaction with our Services.
  • A profile reflecting your preferences and behavior (e.g., your preferred music genres based on events viewed or attended in connection with your use of the Services).
  • Your social media screen names, nicknames or handles and other information associated with your social media account (should you choose to link your ViewStub account with your social media account).
  • Whether you identify as a male, female or non-binary.
  • Your date of birth. 
  • Payment information such as your credit card number, debit card number, financial account number, expiration dates and security codes, and other similar or related account and authentication data necessary to process payment transactions on our Platform (“Payment Information“).Please note: the third party payment processor that we have engaged to securely process payment transactions on our Platform collects this information directly from you and processes this information on our behalf without sharing this information with us, and we do not at any time directly store or have access to any Payment Information.
  • Additional information requested by Event Organizers (and directly provided by you) in connection with your purchase of tickets or management of your event experience through the Services, such as through custom fields included by the Event Organizer in connection with completing a ticket purchase (e.g., T-shirt size).
  • Any other information (including Personal Information) you choose to provide in any forms or messages submitted by you to us or to others through our Services or using the contact information provided on our Services.

 

From Event Personnel

 

  • Your name.
  • The name of your business.
  • Your (or your business’s) e-mail address.
  • Your (or your business’s) billing, mailing and/or physical address.
  • Your general location (city, state/province and country).  
  • Your (or your business’s) website, social media screen names, nicknames or handles.
  • The IP address or Mobile Device ID of the computer or device used to log in to our Services.
  • Browsing history, search history or other information on your interaction with our Services.
  • A profile reflecting your preferences and behavior (e.g., saved searches or other saved information in connection with your use of our Services).
  • Any other information (including Personal Information) you choose to provide in any forms or messages submitted by you to us or to others through our Services or using the contact information provided on our Services.

 

How We Collect Information

 

With the exception of (1) your IP address or Mobile Device ID and (2) your browsing and transactional history, preferences and patterns on the Services (which we collect automatically as you navigate through or interact with our Services, as described below in the section titled “Traffic, Usage and Computer/Device Information“), generally we collect this information directly from you when you submit it to us in connection with registering to obtain additional information from us (such as signing up to receive our e-newsletter or other marketing and promotional information about us or our Platform), registering for an account on the Platform, communicating with and transacting business with Fans or Event Organizers via our Platform, entering into a sweepstakes, contest, giveaway or other promotion related to our Services, responding to a voluntary survey you have agreed to complete, contacting us for customer service inquiries or reporting a problem with our Services, submitting an inquiry to us using the contact methods provided on our Services, or otherwise contacting us about our Services or our business.

 

Additionally, if you are a Fan we may receive information (including Personal Information) about you directly from Event Organizers that the Event Organizers have elected to upload or otherwise submit to and through our Services.

 

Finally, we may obtain certain Personal Information from integrated third-party applications, programs and/or devices that you elect to use in connection with your use of our Services (“Programs“), such as social media platforms where you choose to link your social media account with the Platform. You should review the third-party privacy policies applicable to information transferred to us from these Programs or from such third parties, since they may allow different or broader uses of that information than would be permitted by our Policy.

 

Traffic, Usage and Computer/Device Information

Additionally, as you navigate through and interact with our Services or interact with the emails, texts and other electronic messages that we or that Event Organizers send to you, we or our third party service providers may automatically collect certain traffic data, usage information, and information about your computer equipment or mobile device, such as your browser and operating system, your wireless carrier, the geographic region from which you are accessing the Services, time stamped logs regarding access times and duration of visits, the pages of our Services that you visit, configuration data, clickstream analytics and your actions and patterns when you use our Services (“Technical Information“). The technologies we use for this automatic data collection may include cookies that are stored on the browser of your computer or mobile device, small embedded electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) and other types of embedded code. We collect this information to manage our content and improve users’ use of our Services; count and review the number of users of our Services and their usage patterns; to track key performance indicators such as pages accessed, frequency of access and other statistical information related to our Services (for example, recording the popularity of certain content and verifying system and server integrity); to identify the portion of users who accesses our Services via different web browsers or mobile operating systems; to recognize if user is a return user of our Services; to store information about a user’s visits; to remember a user’s preferences; and for similar purposes in connection with monitoring, maintaining and improving our Services. Third parties may also collect Technical Information and other information on our behalf as further described in the sections below titled “Use of Google Analytics,” “Use of Facebook Business Tools,” and “Tracking and ‘DO NOT TRACK’.”

 

How We Use Your Information

 

Generally

 

We may use the information we collect about you or that you provide to us, including Personal Information, to: 

 

  • Provide our Services and its contents to you.
  • Provide you with information or services you request from us.
  • Process your transactions and payments via the Platform or otherwise, including by transmitting certain of your Personal Information (including Payment Information) to the third party payment processor that we use for securely processing payment transactions, and to prevent transactional fraud.
  • Deliver and manage tickets to events that you have purchased.
  • Assist Event Organizers in managing attendance at events or otherwise managing Fans’ event experiences.
  • Facilitate Fan-initiated direct message communications with Event Organizers, such as if a Fan chooses to use the Services to contact Event Organizers directly with questions about an upcoming event.
  • Facilitate Fan-initiated messages to Event Organizers or other Fans via the “chat” feature in connection with virtual events.  
  • Create, maintain, personalize and secure your account with us.
  • Authenticate or otherwise verify your identity in connection with your requests, purchases, transactions and payments via the Services or otherwise
  • Provide you with support and to respond to your inquiries and customer service requests, including to investigate and address your concerns and to monitor and improve our responses.
  • If you are a Fan, provide you with informational and transactional text message alerts (such as purchase confirmations, links to where you may download tickets to events you have purchased, and important notifications about updates to events to which you have purchased tickets) as described below in the section titled “Text Message Alert Service.”
  • Link to and connect you to where you can download our mobile application on the Apple App Store or Google Play Store.
  • Update and maintain subscription, email or mailing lists (such as our email lists to receive newsletters or alerts by email).
  • Help maintain the safety, security, and integrity of our Services, databases and other technology assets and our business.
  • For advertising, promotional and marketing purposes as described in the section below titled “Use of Personal Information for Marketing Purposes.”
  • With respect to aggregated and de-identified information, fulfill the purposes described in the section below titled “Use and Disclosure of Aggregated and De-Identified Data.”
  • With respect to Technical Information, fulfill the purposes described in the section above titled “Traffic, Usage and Computer/Device Information.” 
  • Register you for sweepstakes, contests, giveaways or other promotions that you have elected to participate in.
  • Notify you about changes to our Services, products or services or this Policy.
  • Respond to lawful requests for information through court orders, subpoenas, warrants and other legal processes or obligations.
  • Enforce any contracts between you and us or between you and either a Fan and/or an Event Organizer, including for billing and collection, or for the establishment, exercise or defense of legal claims.
  • Evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which information (including Personal Information) held by us is among the assets transferred.
  • Fulfill any other purpose for which you provide the information.
  • Serve any other purpose that we describe when you provide the information and for any other purpose with your consent. 

Use of Personal Information for Marketing Purposes 

We may use your information (including Personal Information) for advertising, promotional and other marketing purposes in various ways. This includes using your information (including Personal Information) in the following ways:

 

  • Providing you with informational content and promotional materials regarding the Services and our other products and services.
  • Providing you with informational and promotional content and materials regarding the products and services of Event Organizers (or other affiliates or third parties with whom we have partnered) that we believe may be of interest to you.
  • Providing you with informational and promotional content and materials regarding events that we believe may be of interest to you based on events you have viewed on the Services, past ticket purchases placed via the Services, preferences you have input into the Services or other inferences drawn from your browsing and transactional patterns and actions on and in connection with the Services.
  • Personalizing your Services experience and delivering content and product and service offerings related to your interests, including by delivering personalized email content to you or by displaying targeted offers and ads to you on third-party sites that you visit and on which we place (or our third party service providers place on our behalf) such ads.
  • Using third-party tools (such as Facebook Business Tools – see section below titled “Use of Facebook Business Tools“) to advertise to third parties with similar interests, hobbies or demographic information as you.

Third-Party Services

Our Services may include links to blogs, social media and third-party websites (including but not limited to Event Organizer websites). These third-party sites have their own privacy policies and terms of use and are not controlled by this Policy. You should carefully review any terms, conditions and policies of such third-party sites before visiting them or supplying them with any personal information. If you follow a link on our Services to any third-party site, any information you provide to that site will be governed by its own terms of use and privacy policy and not this Policy. 

 

You may be able to use social media widgets (e.g., the Facebook “Like” button) while using our Services. These widgets will collect your IP Address and identify which page you are visiting on our Services and make your preference information available to third parties. The information collected by such widgets is controlled by third-party privacy policies.

 

We are not responsible for the privacy or security of any information you provide to a third-party website or the information practices used by any third-party site, including links to any third-party site from our Services. We make no representations, express or implied, concerning the accuracy, privacy, safety, security, or the information practices of any third-party site. The inclusion of a link to a third-party site on our Services does not constitute any type of endorsement of the linked site by us. We are not responsible for any loss or damage you may sustain resulting from your use of any third-party website or any information you share with a third-party website.

 

Use and Disclosure of Aggregated or De-Identified Data

We may pseudonymize some Personal Information of users so that it can no longer be attributed to a particular, identifiable user without the use of other separately maintained information, or we may convert or combine some Personal Information of users into de-identified or aggregated data that does not disclose any of the Personal Information of any individual user. As an example, if you are a Fan, we may pseudonymize, de-identify or aggregate information provided by or collected about you and other Fans to generate aggregate trends or insights about the purchasing and attendance behavior of fans generally that may be shared (including for commercial purposes) with our Event Organizer customers to better understand their audiences and attendees to improve their event experiences and their advertising, promotional and marketing efforts relating to their events. You understand and agree that we may use and disclose to third parties any such pseudonymized, de-identified or aggregated data for any lawful purpose.  

 

Tracking and “DO NOT TRACK”

 

Tracking involves the use of cookies, web beacons, or other embedded code or tracking technologies to collect, analyze and store information on a user’s behavior over time on multiple sites, including information on the sites visited, products viewed, products purchased and other online interactions. Tracking information can be used to enable companies to make interest-based (behavioral) advertising available to users on multiple sites that they visit.

 

We may (or our third party service providers may on our behalf) collect Personal Information about your online activities over time and across third-party sites for tracking purposes when you use our Services. However, we do not currently allow third parties to collect Personal Information through or using our Services that could be used by them to analyze and store information about your online activities over time and across third-party sites for their own tracking purposes (separate and apart from any services they provide to us in support of our permitted uses of your Personal Information as described in this Policy).

Use of Google Analytics

 

We use Google Analytics to track and analyze certain traffic and usage statistics regarding the use of our Services, such as the number of visitors to our Services, how visitors are navigating to our Services, visitors’ general geographic region information, how long individuals are visiting our Services, and information about the equipment individuals are using to access our Services (e.g., browser version and operating system). Google Analytics may use a Google Analytics cookie as part of this service, and we may share certain Personal Information with Google Analytics as part of this service. We use this traffic and usage information to gauge, internally, the effectiveness of our advertising efforts and to make improvements to our Services and our marketing and promotional efforts.

 

In addition, we may use the following Google Analytics Advertising Features:

  • Google Analytics Demographics and Interest Reporting
  • Google Ads (as an integrated service with Google Analytics)

By enabling these features, we and certain third-party vendors use first-party cookies (such as the Google Analytics cookie) or other first-party identifiers, and third-party cookies (such as Google advertising cookies) or other third-party identifiers together for various purposes. The information collected includes demographic information about our visitors and general information about our visitors’ interests. We use the information collected through our use of the Google Analytics Advertising Features to track purchasing behavior, segment our audience and to better target our advertising and marketing efforts (for our own and others’ products and services) and allow third-party vendors to do the same, for example to (1) display targeted advertisements to individuals who viewed tickets on our Website but did not make a purchase or sign up for an account, (2) target visitors from a certain geographic region with certain ads in Google search results that have previously shown a high degree of success for consumers in that region, (3) advertise our or others’ products and services across other websites that you may visit, or (4) allow Google or other third-party vendors to show you ads on websites that you visit after using our Services or clicking on an offer or ad in one of our emails or in our Website.

Use of Facebook Business Tools

 

We may use various advertising services and business tools on Facebook in connection with our Services. The services and tools we may use are summarized on Facebook’s website. If you are a Fan, you may have the option to sign up for informational and transactional text message alerts concerning events to which you have purchased tickets. Please refer to our End User Terms of Service [https://viewstub.com/company/terms] for more information about our SMS text message alert service. Information on opting out of this service may be found below under the section titled “Your Rights and Choices.”

 

If you have opted in to receiving text message alerts from one or more Event Organizers through our Platform, please be advised that (pursuant to our contracts with all Event Organizers) Event Organizers are prohibited from sending you marketing or promotional communications via text message under any circumstances. They are permitted only to deliver informational and transactional text messages relating to events to which you have already purchased tickets. If you receive text message communications directly from Event Organizers that you believe are inconsistent with the statements above, please contact us immediately at support@viewstub.com so that we may investigate the matter and otherwise assist you.  

 

Disclosure of Your Information

 

We may share your Personal Information with third parties in the following circumstances:

 

  • We may disclose Personal Information to any contractors, service providers and other third parties who need to know such information (or such contractors, service providers or other third parties may collect Personal Information directly from you on our behalf while you use our Services) in order to provide services to us that support our hosting, maintenance, operation and promotion of our Services and our business and our permitted uses of Personal Information under this Policy. For example, we may use a third party cloud-hosting infrastructure service provider (e.g., Amazon Web Services, Google Cloud or Microsoft Azure), we may use a customer relationship management or an e-mail marketing software platform offered by a third party service provider, we may use a third party payments processor to securely process payment transactions through our Services, we may use certain third-party advertising service providers (such as Facebook as described above in the section titled “Use of Facebook Business Tools“), and we use Google Analytics in connection with our Services as described above in the section titled “Use of Google Analytics.”
  • We may disclose Personal Information to (or permit Personal Information to be collected on our Services by) certain third parties for promotional and advertising purposes as described in the sections above titled “Tracking and Do Not Track,” “Use of Google Analytics” and “Use of Facebook Business Tools.
  • If you are a Fan, we may additionally disclose your information (including Personal Information) to Event Organizers in the following limited circumstances:
  • If you purchase a ticket for an event hosted by an Event Organizer, you agree and understand you are using the Services to intentionally disclose your information to that Event Organizer for the purpose of the Event Organizer’s efforts to track and manage attendance at the event and otherwise manage your event experience. For example, Event Organizers may request from us (and we may provide) a list of names of event attendees that have purchased tickets to a particular event that the Event Organizer may use to verify attendance and/or seat assignments at the event.
  • If you choose to use our “Contact the Event Organizer” functionality on the Services to initiate a direct message communication with an Event Organizer, you agree and understand you are using the Services to intentionally interact with the Event Organizer and that you will receive response communications from the Event Organizer through the Platform. In connection with this, your name, screen name or other identifier needed to facilitate dialogue with the Event Organizer may be shared with the Event Organizer. If in connection with your direct message communications with an Event Organizer you choose to submit additional Personal Information to the Event Organizer (such as by including it in the content of your message submitted to the Event Organizer) you agree and understand that you are voluntarily and directly transferring your Personal Information to the Event Organizer and that (1) the Event Organizer will have its own privacy policy and practices for how they collect, store, use, disclose, protect and otherwise process Personal Information, (2) you should carefully review the policies of such Event Organizer before choosing to supply them with Personal Information, (3) we cannot control (and therefore we are not and will not be responsible for) the privacy or security of any information you provide to an Event Organizer in this manner or the practices used by the Event Organizer with respect to information you provide to the Event Organizer in this manner, (4) we make no representations, express or implied, concerning the privacy, safety, security, or the information practices of any Event Organizer, and (5) we are not and will not be liable for any loss or damage you may sustain resulting from your submission of any information you provide to the Event Organizer in this manner.
  • If you choose to use our “chat” function in connection with your attendance at a virtual event, the content of the messages you submit to the “chat” function will be displayed to third parties, including Fans and Event Organizers. Your “chat” messages are posted through the Services and transmitted to others at your own risk. Although all messages submitted to and through our Services must comply with the content standards set forth in our End User Terms of Service and our contracts with Event Organizers, and while we strive to foster an environment at virtual events that encourages positive and responsible dialogue among Fans and Event Organizers, we cannot control (and therefore are not and will not be responsible or liable for) the messages submitted by other users of the Services or the actions of other users of the Services with whom you may choose to share your messages in turn.

If you receive communications directly from Fans or Event Organizers that you believe are inconsistent with the statements above, please contact us immediately at support@viewstub.com so that we may investigate the matter and otherwise assist you.

 

  • We may disclose Personal Information to our affiliates or to a buyer or other successor to our business in the event of a sale of equity or assets, reorganization, merger, divestiture or a similar corporate transaction, whether as a going concern or as part of a bankruptcy, liquidation or similar proceeding, and any due diligence review with respect to any such proposed transaction.
  • We may disclose Personal Information to comply with any court order, law or legal process, including to meet national security and law enforcement requirements or to respond to any government or regulatory request or audit. 
  • We may disclose Personal Information to enforce or apply any legal agreements between us and you, or if we believe disclosure is necessary or appropriate to protect the rights, property or safety of our customers or others.

We may also disclose your Personal Information for any purpose disclosed when the information is provided, and for any other purpose with your consent.

 

Choices About How We Use and Disclose Your Information

 

You have certain choices regarding the Personal Information you provide to us. You can set your browser to refuse all or some browser cookies. If you choose not to accept cookies, you may be unable to access certain parts or pages of our Services, or certain parts, pages or features of our Services may not function properly.

 

If you do not wish to have your Personal Information used by us or by Event Organizers to contact you with promotional content or messages, you may update your preferences any time by adjusting the privacy settings in your ViewStub account profile, you may send us an email stating your request to support@viewstub.com or you can opt-out by simply clicking on the “Unsubscribe” or “Updating your email preferences,” link in the most recent email you received and follow the prompts that appear. This opt-out does not apply to transactional notifications (e.g., purchase confirmations or deliveries of copies of tickets you have purchased), informational notifications (e.g., notifications regarding important updates to events to which you have purchased tickets) or notifications about changes to our Services or this Policy.

 

If you have enrolled in our text message alert service, you may opt out of this service (i.e., stop all text messages) at any time. With respect to any text message, you may reply STOP to end all messages, or you may opt out by adjusting the settings on your account settings page or by contacting us using one of the methods listed at the end of this Policy. In each case, please allow us a few days to process your opt out request.

 

We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI“) on the NAI’s https://thenai.org/opt-out/.

Accessing and Correcting Your Information

 

You may send us an email at support@viewstub.com to request access to any Personal Information that you have provided to us, or to correct or delete that Personal Information. For security reasons, we may need to request specific information from you to help us confirm your identity before we correct, update or delete any Personal Information you provide us. We will evaluate such requests on a case-by-case basis. In certain cases we cannot delete your Personal Information. For example, we cannot continue to maintain your account on the Platform without retaining certain portions of your Personal Information, so a request to delete certain forms of Personal Information may require the deletion of your account and cessation of services to you. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

 

Users Outside of the States
